Настоящий документ является публичной офертой компании Wellwon Limited, зарегистрированной в Специальном административном районе Гонконг по Ордонансу о компаниях (Cap. 622), BR No. 76756073-000-07-25-8, адрес: Rm 1921, 19/F Star House, 3 Salisbury Road, Tsim Sha Tsui, Гонконг. Акцептом является регистрация аккаунта, оплата или начало использования Сервиса (ст. 438 ГК РФ).

1. Определения

«Сервис» — VPN-сервис Zanaves: ПО, приложения, серверная инфраструктура Компании.

«Подписка» — платный тарифный план, предоставляющий доступ к Сервису.

«Аккаунт» — зарегистрированный профиль Пользователя.

«Протоколы» — VPN-протоколы Сервиса; в настоящее время это Amnezia v2 и AmneziaWG. Дополнительные протоколы (например, VLESS, Hysteria) могут добавляться со временем.

«Политика нулевого журналирования (No-Log Policy)» — обязательство не хранить историю просмотров, DNS-запросы, исходные IP-адреса и содержание трафика.

2. Требования к Пользователю

Пользователь должен быть не моложе 18 лет и обладать полной дееспособностью.

3. Регистрация аккаунта

Аккаунт создаётся путём указания действующего email. Пользователь несёт ответственность за безопасность учётных данных. Об обнаружении несанкционированного доступа сообщать на [email protected].

4. Стоимость и порядок оплаты

4.1 Тарифные планы

Перечень тарифов опубликован на https://zanaves.net.

4.2 Оплата

Оплата через Enot.io (www.enot.io), Система быстрых платежей (СБП) / Fast Payment System (FPS). Все платежи в российский рубль (RUB, ₽) / Russian Ruble (RUB). Реквизиты карт/счетов Компанией не хранятся. Совершая оплату, Пользователь подтверждает обработку данных Enot.io по их оферте: https://enot.io/documents/oferta.pdf.

4.3 Продление

Подписка НЕ продлевается автоматически. По истечении оплаченного периода доступ прекращается. Для продолжения использования Сервиса необходимо вручную продлить подписку в Аккаунте.

4.4 Возврат средств

Подписка является предоплатной; доступ к Сервису открывается сразу после оплаты, и Компания несёт инфраструктурные издержки с момента активации. По общему правилу оплаченная подписка возврату не подлежит. Пользователь не может в одностороннем порядке досрочно прекратить оплаченный период и потребовать возврат средств за неиспользованный остаток. Исключения:

• (a) Период охлаждения (48 часов). Полный возврат возможен в течение 48 часов с момента первоначальной оплаты при условии, что под Аккаунтом ни разу не устанавливалось VPN-соединение (то есть оказание услуги фактически не началось).
• (b) Возврат по индивидуальному рассмотрению. В исключительных случаях возврат может быть предоставлен по обращению на [email protected] при наличии обоснованной персональной причины. Такой возврат осуществляется исключительно на усмотрение Компании.

Одобренные возвраты обрабатываются в течение 30 рабочих дней через СБП на номер телефона, указанный Пользователем в заявке.

4.5 Гарантия работоспособности и замена ключа

Ключевое обязательство Компании — непрерывность связи, а не доступ из какой-либо конкретной страны. Компания поддерживает постоянно ротируемый динамический пул серверов и протоколов, чтобы соединение оставалось рабочим.

• Если Сервис не работает по причине, находящейся под контролем Компании (например, отказ ноды или невалидный ключ), Компания бесплатно: (i) заменяет ключ и/или переводит Пользователя на рабочий сервер и (ii) при длительном простое, вызванном Компанией, продлевает Подписку на срок простоя. Восстановление сервисом — основной механизм возмещения, а не денежный возврат.
• Причины вне контроля Компании не являются основанием для возврата средств, включая: (a) блокировку, замедление или ограничение VPN-трафика, отдельных протоколов или методов обфускации со стороны государства или регулятора (включая Российскую Федерацию); (b) обнаружение или блокировку VPN-трафика сторонними сайтами, стриминговыми, банковскими или игровыми сервисами; (c) сбои устройства, операционной системы или интернет-провайдера Пользователя; (d) форс-мажор. В таких случаях Компания всё равно стремится восстановить связь ротацией пула, но возврат средств не производится (см. Отказ от ответственности §§4, 8).

5. Количество подключений и добросовестное использование

Каждый Аккаунт привязан к одному устройству одновременно (один аккаунт-ключ — одно устройство). Ключ можно перенести (re-bind) на другое устройство, однако Сервис не может одновременно использоваться на нескольких устройствах. Пользователь обязуется использовать Сервис добросовестно. Запрещается: автоматическая генерация трафика, запуск серверных приложений через туннель, майнинг криптовалюты, действия, создающие чрезмерную нагрузку на инфраструктуру. Компания вправе ограничить доступ при нарушении данного условия.

6. Технические протоколы и особенности Сервиса

Сервис использует VPN-протоколы; в настоящее время это Amnezia v2 и AmneziaWG (дополнительные протоколы, например VLESS, Hysteria, могут добавляться). Доступность протоколов зависит от платформы и региона. Все VPN-серверы работают на RAM-носителях (diskless) — данные не записываются на постоянные носители и уничтожаются при перезагрузке.

Сервис включает функцию аварийного отключения (kill switch), блокирующую трафик при обрыве VPN. Kill switch является функцией защиты с максимальными усилиями и не гарантирован во всех ситуациях. Подробнее — в Отказе от ответственности.

7. Допустимое использование

Запрещается использовать Сервис для: (а) нарушения законодательства; (б) нарушения прав интеллектуальной собственности; (в) распространения вредоносного ПО; (г) несанкционированного доступа к системам; (д) автоматической генерации трафика; (е) майнинга криптовалюты через туннель; (ж) перепродажи доступа.

8. Авторские права

Компания уважает права интеллектуальной собственности. Сервис является транзитным каналом и не контролирует передаваемый контент.

В связи с Политикой нулевого журналирования Компания не может идентифицировать конкретного Пользователя. Уведомления о нарушении прав направлять на: [email protected].

9. Особое уведомление о юрисдикции

СЕРВИС ЭКСПЛУАТИРУЕТСЯ ИЗ ГОНКОНГА. ИСПОЛЬЗОВАНИЕ VPN МОЖЕТ БЫТЬ ОГРАНИЧЕНО ИЛИ ЗАПРЕЩЕНО В РФ И ИНЫХ ЮРИСДИКЦИЯХ. ПОЛЬЗОВАТЕЛЬ САМОСТОЯТЕЛЬНО НЕСЁТ ОТВЕТСТВЕННОСТЬ ЗА СООТВЕТСТВИЕ СВОИХ ДЕЙСТВИЙ ТРЕБОВАНИЯМ ПРИМЕНИМОГО ЗАКОНОДАТЕЛЬСТВА. КОМПАНИЯ НЕ НЕСЁТ ОТВЕТСТВЕННОСТИ ЗА ПОСЛЕДСТВИЯ ИСПОЛЬЗОВАНИЯ СЕРВИСА.

10. Интеллектуальная собственность

Все исключительные права на Сервис принадлежат Компании. Пользователю предоставляется ограниченная неисключительная лицензия.

11. Персональные данные и cookies

Обработка данных — согласно Политике конфиденциальности и Политике в отношении cookies, размещённым на https://zanaves.net/legal.

12. Прозрачность и аудиты

Компания публикует Warrant Canary, обновляемый ежеквартально. Компания проходит регулярные независимые аудиты Политики нулевого журналирования, отчёты публикуются на https://zanaves.net/legal.

13. Отказ от гарантий

СЕРВИС ПРЕДОСТАВЛЯЕТСЯ «КАК ЕСТЬ». КОМПАНИЯ НЕ ГАРАНТИРУЕТ БЕСПЕРЕБОЙНОСТЬ ИЛИ АБСОЛЮТНУЮ АНОНИМНОСТЬ.

14. Ограничение ответственности

СОВОКУПНАЯ ОТВЕТСТВЕННОСТЬ КОМПАНИИ НЕ ПРЕВЫШАЕТ СУММУ, УПЛАЧЕННУЮ ЗА 3 МЕСЯЦА ДО СОБЫТИЯ. КОСВЕННЫЕ УБЫТКИ НЕ ВОЗМЕЩАЮТСЯ.

15. Изменение условий

Актуальная версия — на https://zanaves.net. Продолжение использования = согласие.

16. Применимое право и разрешение споров

Договор регулируется правом Гонконга. Споры — арбитраж HKIAC. Язык — английский. Решение окончательно.

17. Заключительные положения

В случае расхождения версий приоритет за английской. Договор составляет полное соглашение сторон.

Terms of Service (English)

These Terms of Service ("Terms") constitute a legally binding agreement between Wellwon Limited, a company incorporated in Hong Kong (Companies Ordinance Cap. 622), BR No. 76756073-000-07-25-8, registered at Rm 1921, 19/F Star House, 3 Salisbury Road, Tsim Sha Tsui, Hong Kong ("Company"), and any person who accesses or uses Zanaves ("Service"). By registering, paying, or using the Service you agree to these Terms.

1. Definitions

"Service" — the Zanaves software, applications, servers and infrastructure operated by the Company.

"Subscription" — a paid plan granting access to the Service for a defined period.

"Account" — the registered user profile created to access the Service.

"Permitted Protocols" — VPN tunnelling protocols currently including Amnezia v2 and AmneziaWG. Additional protocols (e.g. VLESS, Hysteria) may be added over time.

"No-Log Policy" — commitment not to record or store User browsing activity, DNS queries, original IP addresses, or traffic content.

2. Eligibility

You must be at least 18 years of age and have full legal capacity to enter this Agreement.

3. Account Registration

Create an Account with a valid email address. You are responsible for all activity under your Account. Report unauthorised access immediately to [email protected].

4. Subscriptions and Payment

4.1 Plans

Plans, pricing and features are published at https://zanaves.net and may be updated from time to time.

4.2 Payment

Payments are processed through Enot.io (www.enot.io), Система быстрых платежей (СБП) / Fast Payment System (FPS). All payments are in российский рубль (RUB, ₽) / Russian Ruble (RUB). The Company does not store card or bank details. By paying you acknowledge that your transaction data is processed by Enot.io under their terms at https://enot.io/documents/oferta.pdf.

4.3 Renewal

Subscriptions do NOT renew automatically. At the end of the paid period, the Service will cease unless you manually renew your Subscription via your Account at https://zanaves.net.

4.4 Refunds

The Service is provided on a prepaid subscription basis; access is granted immediately upon payment and the Company incurs infrastructure costs from activation. As a general rule, subscriptions are non-refundable. A User may not unilaterally terminate a paid period early and reclaim funds for the unused remainder. Exceptions:

• (a) Cooling-off (48 hours). A full refund is available within 48 hours of the initial purchase, provided that no VPN connection has ever been established under the Account (i.e. the Service has not begun).
• (b) Discretionary refund. In exceptional cases, a refund may be granted on individual review by contacting [email protected] with a substantiated personal reason. Such refunds are issued at the Company's sole discretion.

Approved refunds are processed within 30 business days via SBP transfer to the phone number provided by the User in the refund request.

4.5 Service Availability Guarantee & Key Replacement

The Company's core commitment is continuity of connectivity, not access from any specific country. The Company operates a continuously rotating, dynamic pool of servers and protocols to keep your connection working.

• If the Service fails to connect due to a cause within the Company's control (e.g. a failed node or an invalid key), the Company will, at no charge, (i) replace your key and/or rotate you onto a working server, and (ii) where an outage attributable to the Company persists, extend your Subscription by the duration of the outage. Service remediation — not a cash refund — is the primary remedy.
• Causes outside the Company's control are not grounds for a refund, including: (a) blocking, throttling, or restriction of VPN traffic, specific protocols, or obfuscation methods by a government or regulator (including the Russian Federation); (b) detection or blocking of VPN traffic by third-party websites, streaming, banking, or gaming services; (c) failures of the User's device, operating system, or local internet provider; (d) force majeure. In such cases the Company will still endeavour to restore connectivity by rotating the pool, but no refund is due (see Disclaimer §§4, 8).

5. Device Connections and Fair Use

Each Account is bound to one device at a time (one account-key, one device). You may transfer (re-bind) your key to a different device, but the Service may not be used on multiple devices simultaneously. You agree to use the Service in a fair and reasonable manner. Prohibited: automated traffic generation, operating server-side applications through the tunnel, cryptocurrency mining via VPN, and activities that unreasonably burden the network infrastructure. The Company may throttle or suspend Accounts that violate fair use.

6. Technical Protocols and Service Features

The Service uses industry-standard VPN protocols, currently Amnezia v2 and AmneziaWG (additional protocols such as VLESS and Hysteria may be added). Protocol availability may vary by platform and region. All VPN servers operate on RAM-only (diskless) infrastructure — no user data is written to permanent storage on VPN servers.

The Service includes a kill switch feature designed to block internet traffic if the VPN connection drops unexpectedly. The kill switch is a best-effort feature and is not guaranteed to function in all circumstances. See the Disclaimer for full details.

7. Acceptable Use

You agree NOT to use the Service to: (a) violate any applicable law; (b) infringe intellectual property rights; (c) transmit malware or conduct phishing; (d) attempt unauthorised access to any system; (e) conduct automated scraping or bot traffic at scale; (f) mine cryptocurrency via the VPN tunnel; (g) resell or sublicense access without written consent; (h) circumvent third-party terms of service.

8. DMCA and Copyright

The Company respects intellectual property rights and expects Users to do the same. The Service operates as a transitory digital network communications provider and does not monitor, store, or control content transmitted through the Service.

Due to its strict No-Log Policy, the Company cannot identify individual Users in response to copyright infringement notices. Copyright notices should be sent to [email protected]. Users who repeatedly infringe third-party intellectual property rights may have their Accounts suspended.

9. Jurisdiction-Specific Notice

THE SERVICE IS OPERATED FROM HONG KONG. VPN USAGE MAY BE RESTRICTED, REGULATED, OR PROHIBITED IN CERTAIN JURISDICTIONS, INCLUDING THE RUSSIAN FEDERATION. YOU ARE SOLELY RESPONSIBLE FOR DETERMINING WHETHER YOUR USE OF THE SERVICE COMPLIES WITH THE LAWS OF YOUR JURISDICTION. THE COMPANY ACCEPTS NO LIABILITY FOR ANY CONSEQUENCES ARISING FROM YOUR USE OF THE SERVICE IN A RESTRICTED JURISDICTION.

10. Intellectual Property

All rights in the Service remain the exclusive property of the Company or its licensors. You receive a limited, non-exclusive, non-transferable, revocable licence to use the Service in accordance with these Terms.

11. Privacy and Cookies

Your use of the Service is subject to our Privacy Policy and Cookie Policy, both available at https://zanaves.net/legal and incorporated herein by reference.

12. Transparency and Audits

The Company maintains a Warrant Canary, updated quarterly, confirming we have not received any secret government surveillance orders. If the Warrant Canary is not updated, users should treat it as compromised. The Company also commits to regular independent audits of its No-Log Policy, with reports published at https://zanaves.net/legal.

13. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. THE COMPANY DOES NOT WARRANT UNINTERRUPTED, ERROR-FREE, OR SECURE SERVICE, NOR DOES IT GUARANTEE COMPLETE ANONYMITY.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY'S TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE THREE (3) MONTHS PRECEDING THE CLAIM. THE COMPANY IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

15. Indemnification

You agree to indemnify and hold harmless the Company from any claims, liabilities, damages, and expenses arising from: (a) your use of the Service; (b) your breach of these Terms; (c) your violation of applicable law or third-party rights.

16. Term and Termination

The Company may suspend or terminate your Account immediately and without prior notice for breach of these Terms.

17. Modifications

The Company may modify these Terms at any time by posting the revised version at https://zanaves.net. Continued use constitutes acceptance.

18. Governing Law and Dispute Resolution

These Terms are governed by the laws of Hong Kong SAR. Any dispute shall be finally resolved by arbitration administered by the Hong Kong International Arbitration Centre (HKIAC) under the HKIAC Administered Arbitration Rules. Seat: Hong Kong. Language: English. The award is final and binding.

19. General

These Terms constitute the entire agreement between the parties. If any provision is unenforceable, the remainder continues in full effect. The English version prevails in case of conflict.
