Настоящий документ является неотъемлемой частью Публичной оферты компании Wellwon Limited (BR No. 76756073-000-07-25-8) в отношении сервиса Zanaves.

2. Риск юрисдикции

СЕРВИС ЭКСПЛУАТИРУЕТСЯ ИЗ ГОНКОНГА. ИСПОЛЬЗОВАНИЕ VPN МОЖЕТ БЫТЬ ОГРАНИЧЕНО ИЛИ ЗАПРЕЩЕНО В РФ И ИНЫХ ЮРИСДИКЦИЯХ. ПОЛЬЗОВАТЕЛЬ ИСПОЛЬЗУЕТ СЕРВИС НА СВОЙ СТРАХ И РИСК И НЕСЁТ ЕДИНОЛИЧНУЮ ОТВЕТСТВЕННОСТЬ ЗА: (А) ОПРЕДЕЛЕНИЕ ЗАКОННОСТИ ИСПОЛЬЗОВАНИЯ VPN; (Б) СОБЛЮДЕНИЕ ПРИМЕНИМОГО ЗАКОНОДАТЕЛЬСТВА; (В) ЛЮБЫЕ ПОСЛЕДСТВИЯ ТАКОГО ИСПОЛЬЗОВАНИЯ.

3. Отсутствие гарантии анонимности

VPN снижает, но не устраняет риск идентификации. Государственные органы могут идентифицировать Пользователя техническими или правовыми методами. Компания за это ответственности не несёт.

4. Отсутствие гарантии бесперебойности

Сервис может быть недоступен вследствие технических сбоев, обслуживания или действий регуляторов. Компания не возмещает убытки от недоступности.

5. Отсутствие гарантии безопасности

Абсолютная безопасность передачи данных через интернет невозможна. Компания применяет отраслевые стандарты, но не несёт ответственности за инциденты вне её разумного контроля.

6. Ограничения функции аварийного отключения (Kill Switch)

Сервис включает kill switch — функцию блокировки трафика при обрыве VPN-соединения. Тем не менее Компания не гарантирует корректную работу kill switch во всех ситуациях, включая: (а) сбои или обновления ОС; (б) конфликты приложений или изменения прав; (в) сбои маршрутизатора; (г) несовместимые сетевые конфигурации; (д) IPv6-трафик на отдельных платформах. Kill switch — функция защиты с максимальными усилиями. Не полагайтесь на неё как на единственное средство защиты. Компания не несёт ответственности за утечку данных вследствие сбоя kill switch.

7. Риск утечки DNS

DNS-запросы могут в отдельных случаях направляться за пределы зашифрованного VPN-туннеля (DNS leak) вследствие поведения ОС, настроек провайдера или сторонних приложений. Это может раскрыть историю посещений интернет-провайдеру. Компания применяет меры предотвращения DNS-утечек, но не гарантирует полную защиту во всех конфигурациях. Рекомендуется периодически проверять соединение с помощью инструментов тестирования DNS-утечек.

8. Блокировка VPN сторонними сервисами

Ряд сайтов, стриминговых платформ, банков и иных онлайн-сервисов обнаруживает и блокирует VPN-трафик. Компания не гарантирует доступ к конкретным ресурсам. Возможность доступа зависит от сервера и может меняться без предупреждения. Возврат средств не производится исключительно по причине блокировки VPN сторонними сервисами.

9. Ответственность за контент

Компания — нейтральный посредник, не контролирующий трафик. Пользователь несёт единоличную ответственность за контент и его соответствие применимому законодательству.

10. Сторонние сервисы

Компания не несёт ответственности за сторонние сервисы, доступные через VPN-туннель.

11. Форс-мажор

Компания не несёт ответственности за неисполнение обязательств вследствие обстоятельств непреодолимой силы, включая действия государственных органов.

12. Ограничение ответственности

СОВОКУПНАЯ ОТВЕТСТВЕННОСТЬ КОМПАНИИ НЕ ПРЕВЫШАЕТ СУММУ, УПЛАЧЕННУЮ ЗА 3 МЕСЯЦА ДО СОБЫТИЯ. КОСВЕННЫЕ УБЫТКИ НЕ ВОЗМЕЩАЮТСЯ.

13. Применимое право

Регулируется правом Гонконга. Арбитраж HKIAC. В случае расхождения версий приоритет за английской.

Nothing in this Disclaimer or any other document issued by the Company constitutes legal advice. Consult a qualified legal professional in your jurisdiction before using the Service.

2. Jurisdiction-Specific Risk

THE SERVICE IS OPERATED FROM HONG KONG. VPN USAGE MAY BE RESTRICTED, REGULATED, OR PROHIBITED IN CERTAIN JURISDICTIONS, INCLUDING THE RUSSIAN FEDERATION. IF YOU ACCESS THE SERVICE FROM SUCH A JURISDICTION, YOU DO SO ENTIRELY AT YOUR OWN RISK. THE COMPANY ACCEPTS NO LIABILITY FOR ANY LEGAL CONSEQUENCES. YOU ARE SOLELY RESPONSIBLE FOR: (A) DETERMINING THE LEGALITY OF VPN USE IN YOUR JURISDICTION; (B) COMPLYING WITH ALL APPLICABLE LOCAL LAWS; (C) ANY CONSEQUENCES ARISING FROM SUCH USE.

3. No Guarantee of Anonymity

VPN technology reduces but does not eliminate the risk of traffic interception or user identification. Government authorities or third parties may, through technical means or legal process, identify users notwithstanding VPN use. The Company is not liable for any such identification or disclosure.

4. No Guarantee of Uninterrupted Service

The Service may be unavailable due to technical failures, maintenance, network conditions, or regulatory actions by any government. The Company is not liable for any loss or damage resulting from Service unavailability.

5. No Guarantee of Security

No electronic data transmission or storage system is 100% secure. The Company implements industry-standard security measures but is not liable for security breaches or data loss beyond its reasonable control.

6. Kill Switch Limitations

The Service includes a kill switch feature designed to block internet traffic if the VPN connection drops unexpectedly. However, the Company does not guarantee that the kill switch will function correctly in all circumstances, including but not limited to: (a) operating system crashes or unexpected updates; (b) application conflicts or permission changes; (c) router-level network failures; (d) incompatible network configurations or proxy settings; (e) IPv6 traffic on certain platforms. The kill switch is a best-effort protective feature. Do not rely on it as your sole means of privacy protection. The Company is not liable for any data exposure resulting from kill switch failure.

7. DNS Leak Risk

DNS (Domain Name System) queries may occasionally be routed outside the encrypted VPN tunnel due to operating system behaviour, ISP configuration, or third-party application interference — a phenomenon known as a DNS leak. Such leaks may reveal your browsing activity to your internet service provider or other third parties. While the Service implements DNS leak prevention measures, the Company cannot guarantee complete protection against DNS leaks in all operating environments and configurations. Users are encouraged to use DNS leak testing tools periodically to verify their connection security.

8. Third-Party Service Blocking

Some websites, streaming services, banking platforms, gaming services, and other online services actively detect and block VPN traffic. The Company cannot guarantee access to any specific website, service, or platform. The ability to access certain content may vary by server location and may change at any time without notice. No refund will be issued solely because a third-party service blocks VPN traffic.

9. User Responsibility for Content

The Company is a neutral conduit and does not monitor, control, or store content transmitted through the Service. You are solely responsible for all content you transmit or receive and for compliance with applicable law.

10. Third-Party Services

The Company does not endorse or accept responsibility for third-party services, websites, or content accessed via the Service. Use of third-party services is at your own risk and subject to their own terms.

11. Force Majeure

The Company is not liable for delays or failures due to circumstances beyond its reasonable control, including acts of government, regulatory actions, network infrastructure failures, or natural disasters.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE THREE (3) MONTHS PRECEDING THE CLAIM. IN NO EVENT SHALL THE COMPANY BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES.

13. Governing Law

This Disclaimer is governed by the laws of Hong Kong SAR. Disputes resolved under HKIAC arbitration per the Terms of Service.
